LA-NET | ONLINE LEARNING VIDEO PLATFORM FOR POST-SECONDARY & HIGHER INSTITUTION STUDENTS Introduction Planning law is the body of rules, statutes, and regulations that govern the use, development, and management of land and physical space. It provides the legal framework through which governments and planning authorities control urban growth, protect the environment, and ensure orderly development. Without planning law, cities and towns would grow in a haphazard manner, leading to congestion, environmental degradation, and social inequality. Understanding what planning law is, how it developed, what objectives it serves, and how it is administered is therefore the essential starting point for any student of planning and urban development. The aim of this Series is to equip you with a clear understanding of the nature and definition of planning law, its historical development in Nigeria, the objectives it pursues, its legal basis, and the institutions and challenges involved in its administration. We shall commence this Series by examining the definition and scope of planning law and its historical development in Nigeria. Next, we will explore the social, economic, environmental, and spatial objectives of planning legislation. Following that, we will study the legal basis of planning in Nigeria, covering constitutional provisions, statutory instruments, and case law. Finally, we will examine the functions of planning authorities and the key challenges of implementing planning legislation in the Nigerian context. Series Learning Outcomes Upon completing this Series, you should be able to: SLO 1.1 define planning law and explain its historical development in Nigeria, SLO 1.2 analyse the social, economic, environmental, and spatial objectives of planning legislation, SLO 1.3 identify and explain the constitutional provisions and statutory instruments that form the legal basis of planning in Nigeria, SLO 1.4 describe the functions of planning authorities and evaluate the challenges of implementing planning legislation in Nigeria. 1.1 The Nature and Definition of Planning Law 1.1.1 Definition and scope of planning law Fill in the blank: Planning law provides the ______ framework through which governments regulate the use, development, and management of land.

Early ordinances focused on sanitation, housing, and the control of public spaces in colonial settlements. The Lagos Town Planning Ordinance of 1928 was among the first formal planning instruments in Nigeria, establishing a basis for controlling development in urban areas. Over time, the framework evolved through successive statutes, including the Town and Country Planning Law of 1946 and later enactments at regional and state levels. The Land Use Act of 1978 was a landmark development: it vested all land in Nigeria in the state, placing its administration under state governors, and fundamentally shaped the legal context within which planning operates to this day. More recent legislation, including the National Urban Development Policy and various state urban and regional planning laws, reflects Nigeria's contemporary efforts to address the challenges of rapid urbanisation, housing deficit, and infrastructure decay. Fill in the blank: The Land Use Act of ______ vested all land in Nigeria in the state and placed its administration under state governors. Pilot questions 1.1 1. Define planning law and explain its principal scope.

State three areas of activity covered by the scope of planning law. 4. Identify two early planning ordinances introduced in Nigeria during the colonial period. 5. Explain the significance of the Land Use Act of 1978 for planning law in Nigeria. 1.2 Objectives and Purposes of Planning Legislation 1.2.1 Social, economic, and environmental objectives Planning legislation serves important social objectives by promoting equitable access to housing, health facilities, schools, and public services. It seeks to ensure that development benefits all segments of the population and does not result in the exclusion of low-income groups from well-served areas of cities. Planning law also advances economic objectives by guiding investment, supporting infrastructure development, and ensuring that land is used efficiently. Zoning laws, for instance, can encourage industrial growth in designated areas while protecting residential neighbourhoods from the adverse effects of pollution and heavy traffic. Environmental objectives are equally central to planning legislation: it seeks to conserve natural resources, reduce pollution, protect ecosystems, and promote green infrastructure within and around urban areas. In Nigeria, the environmental dimension of planning law is particularly relevant given the pressures of urban expansion on wetlands, forested areas, and coastal zones in cities such as Lagos and Port Harcourt. Fill in the blank: Zoning laws encourage ______ growth in designated areas while protecting residential neighbourhoods from pollution and heavy traffic. LA-NET | ONLINE LEARNING VIDEO PLATFORM FOR POST-SECONDARY & HIGHER INSTITUTION STUDENTS 1.2.2 Spatial objectives and sustainable development Planning legislation also pursues spatial objectives, which involve organising land use to achieve balanced urban growth and prevent overcrowding, urban sprawl, and the uncontrolled expansion of informal settlements. Spatial planning seeks to allocate land for different uses in a rational and coordinated manner, ensuring that residential, commercial, industrial, and recreational uses are located where they will function most effectively and cause least conflict. Sustainable development has become an increasingly prominent objective of contemporary planning legislation, reflecting international commitments to manage resources in a manner that meets present needs without compromising the ability of future generations to meet their own needs. In Nigeria, the challenge of achieving sustainable urban development is acute: cities are growing rapidly, infrastructure is under severe pressure, and informality in land use is widespread. Planning legislation that pursues spatial and sustainability objectives must therefore be realistic about implementation capacity and sensitive to the socio-economic conditions of Nigerian cities. Fill in the blank: Planning legislation may require ______ belts around cities to limit sprawl and preserve ecological balance. Pilot questions 1.2 1. State three social objectives that planning legislation seeks to achieve. 2. Explain how zoning laws can serve both economic and environmental objectives simultaneously. 3. Describe what is meant by spatial objectives in the context of planning legislation. 4. Explain what is meant by sustainable development in the context of planning law. 5. Describe two challenges of achieving sustainable urban development in Nigerian cities. 1.3 The Legal Basis of Planning in Nigeria 1.3.1 Constitutional provisions and enabling legislation The Constitution of the Federal Republic of Nigeria is the supreme law of the land, and it provides the foundation for all planning legislation. It establishes the authority of government at federal, state, and local levels to regulate land use and development. Section 20 of the Constitution places an obligation on the state to protect and improve the environment and safeguard the water, air, and land of Nigeria. The Land Use Act of 1978, incorporated into the Constitution by reference, provides the overarching framework for land administration. At the federal level, the Urban and Regional Planning Act provides a national policy framework for planning, while each state has its own planning law or equivalent statute governing development control and land use regulation within its territory. These state laws establish planning authorities, define the procedures for obtaining planning permission, and set out the

Together, the Constitution, the Land Use Act, and state planning statutes form the primary legislative basis for planning in Nigeria.
